The case is directly linked to South Carolina state senator Stephen Goldfinch Jr. who, through his company Caledonia Consulting LLC, sold and shipped stem cells to unlicensed clinics in a criminal operation that lasted more than three years (see below). After examining evidence at a hearing on Jan 27th, 2014, federal judge Frances Stacy dismissed government's claims and pronounced final JUDGMENTS in Dr.Dammai's favor. Dr.Dammai's portion of the case was judged as a technical violation, a class C misdemeanor, with a $500 fine imposed for 'mislabeling' stem cells (quoted from plea agreement: "stem cells and packaging did not contain any directions for use"). The FDA statute applied to this violation defines its underlying nature as: WITHOUT any "intent to defraud or mislead". Dr.Dammai, therefore, can work in all leadership capacities in FDA regulated industry without any restrictions. Further, Judge Stacy RULED that Dr.Dammai's consulting work (2006-2010) was consistent with routine engagements of a university faculty with outside companies for technology development and thus constituted legal earnings. Judge Stacy's RULINGS adjudged 4 points for the mislabeling violation. The deliberate false charges against Dr.Dammai were DISMISSED when Houston, Texas prosecutors Samuel J. Louis and Cedric LaRue Joubert failed to present a single piece of evidence to support the falsehoods DOJ/FBI and FDA propagated through press releases. By hiding the involvement of Stephen Goldfinch and his partner Yair Adereth (see below), and commingling with a separate unrelated case, DOJ/FBI and FDA created a twisted narrative that Dr.Dammai willingly played a major role, which is a complete falsehood. DOJ/FBI and FDA had in their possession copies of the contract agreements which showed Dr.Dammai was an "outside" consultant for Caledonia Consulting LLC (and Global Laboratories LLC, see below) for in vitro research and technology development. Further, by 2011, DOJ/FBI and FDA had collected overwhelming evidence showing Stephen Goldfinch sold and shipped stem cells across interstate borders to unlicensed clinics and received payments from these sales. Despite this, DOJ/FBI and FDA officials knowingly pushed a falsified narrative through federal wires and communication channels with an intent to alter truth and influence the course of justice. When it came time for the jury to weigh evidence on these false claims, prosecutors continually schemed to delay trial to force a plea from Dr.Dammai and strategically added an unnamed defendant to the ongoing case to circumvent the speedy trial clock. After 2 years of fight by Dr.Dammai, prosecutors added a Mexico citizen with no connection to the case, knowing it would take many years to present this defendant to the court if FBI/FDA even intended to look, thus stalling the case. With the trial indefinitely postponed, the only path left for Dr.Dammai to resolve the case within a reasonable time was to agree to a technical misdemeanor of mislabeling (plea entered on July 30, 2013) to sever himself from the case and fight all other charges at a later hearing presided by a federal judge (held on January 27th, 2014) to have the opportunity to confront the falsehood. DOJ/FBI and FDA exploited this misdemeanor plea to plant more falsehood via official press releases (details here) to strengthen their earlier false narrative, as the saying goes - lies begets lies.
Leading up to Jan 27th hearing, prosecutors informed the judge of their plans to present evidence and have FDA/FBI investigating agents testify against Dr.Dammai. However, the FDA and FBI agents did not show up at the hearing, avoiding testifying under penalty of oath. Just prior to Jan 27th hearing, DOJ removed lead prosecutor Samuel J. Louis after he "resigned" following a pioneering story by FITSNEWS in October 2013 which correctly identified SC senator Stephen Goldfinch as the kingpin and direct supplier of stem cells to Francisco Morales and others. FITSNEWS investigative piece alerted the public to Stephen Goldfinch's criminal activities, which had been concealed by DOJ/FBI and FDA, and unraveled the false narrative spread by government officials. FITSNEWS story implicated that DOJ/FBI and FDA officials led a coordinated effort to coverup the direct link between unlicenced doctors and the main players, Stephen Goldfinch and Yair Adereth, and targeted Dr.Dammai instead. After FITSNEWS exposed this truth, along with the FDA and FBI agents, prosecutor Sam Louis also avoided appearing at the January 27th hearing, a testament to the falsehood he spread for many years and the coverup of Goldfinch's crimes he orchestrated. After Sam Louis was removed, Cedric LaRue Joubert, the other prosecutor, sought to gain advantage of the lower burden of proof applied at hearings. Cedric Joubert calculated that prosecution's evidence against Dr.Dammai would likely meet a lower burden of proof, i.e., preponderance of evidence. On Jan 27th 2014, Cedric LaRue Joubert failed to meet even the minimum 'preponderance of evidence' standard required at hearings (as opposed to 'beyond reasonable doubt' standard applied at jury trial). Thus, under the protection of God and against all the odds that DOJ/FBI and FDA piled on for 3 years, Dr.Dammai's case ended with JUDGMENTS as misdemeanor with $500 fine for not labeling vials as "not for human use" or "for in vitro research only". As a result of the JUDGMENTS, Dr.Dammai's work between 2006-2010 as an independent 'outside' consultant was deemed as legal earnings. DOJ/FBI and FDA did not issue press release(s) following the final JUDGMENTS by Judge Frances Stacy. The Original Scam by Stephen Goldfinch and Yair Adereth: Following the publication of FITSNEWS story, South Carolina state senator Stephen Lewis Goldfinch Jr (A.K.A. Stephen Goldfinch, senator) began spreading false witness on Dr.Dammai to hide the truth from public that he was the most prolific illegal stem cell salesman of US origin, selling to Francisco Morales, David Steenblock and other unlicensed practitioners. In light of the 5 million dollars that Goldfinch and Yair Adereth scammed, Stephen Goldfinch ranks at the top of the stem cell fraudsters pile, comfortably beating the next best, a South African man listed on FBI's Most-Wanted, Stephen Van Rooyen, who made $1.2 million dollars. Goldfinch benefited tremendously from the scam he ran for 3-years with his business partner Yair Adereth who co-owned Caledonia Consulting LLC. Stephen Lewis Goldfinch began his scam while attending part-time MBA program at Citadel in 2005 and continued the fraud through his law school at Charleston School of Law, paying for his MBA and law school with the ill-gotten money. Part of their scheme involved the partner Yair Adereth posing as a medical doctor to fraudulently authorize collection of newborn cord blood/tissues from unsuspecting mothers who delivered at maternity clinics in Conway, SC. Stephen Goldfinch's local connections with the doctors operating two maternity clinics in Conway was central in ensuring long-term supply by paying the clinics for newborn cord blood obtained illegally without the informed consent from mothers who delivered at these clinics. DOJ/FBI and FDA continue to hide these details from the public, deliberately preventing the mothers from knowing the truth, perhaps to protect the clinics and Stephen Goldfinch from legal actions. It is impossible to know, without further investigation, how many mothers of minority background were targeted and victimized by Stephen Goldfinch's greed. The cord blood collected through illegal means was submitted to Medical University of South Carolina (MUSC) for testing, where again Yair Adereth posed as a medical doctor to facilitate testing and processing. Stephen Goldfinch had obtained permits and photo ID badge issued by MUSC that allowed him to access MUSC campus and services. Evidence shows that, despite lacking informed consent documents and without verifying Yair Adereth's credentials, MUSC accepted cord blood from Stephen Goldfinch to perform testing and received payments from Stephen Goldfinch for the test reports (FITSNEWS quoted sources confirming this). Stephen Goldfinch exploited the test reports and photo ID badge issued by MUSC in several ways, for example, 1) as supporting documents to market and ship stem cells to unlicensed clinics and, 2) as a stamp of legitimacy to claim his close collaboration with MUSC. In this manner, purified stem cells produced for non-human research purposes was sold by Stephen Goldfinch and Yair Adereth directly to Francisco Morales and others (without Dr.Dammai's knowledge) in a conspiracy to defraud patients with bogus promises that stem cells would cure their condition. After three years of running this criminal scheme, Stephen Goldfinch and Yair Adereth sold Caledonia Consulting LLC and its existing stem cell inventory to Fredda Branyon for $1.8 million. After cashing the money, Stephen Goldfinch shipped 360 vials of stem cells to Fredda Branyon (RN,ND) who formed Global Laboratories LLC with the starting inventory of 360 vials purchased from Stephen Goldfinch. These and other crucial details were buried by DOJ/FBI and FDA to erase the factual context of the case to hide the main culprits and create a falsified narrative. Public were only made aware of the truth when the main elements of the fraud were exposed through FITSNEWS investigative report identifying Stephen Goldfinch as the kingpin. The lucrative scam, described as "heinous crimes", helped Stephen Goldfinch get married and buy houses, one in John's Island, SC. Laughably, Stephen Goldfinch and Yair Adereth claim the John's Island residential unit as their 'Biotech Company', and used it for illegal supply of stem cells to Francisco Morales and others. For 3-years, Stephen Goldfinch and Yair Adereth ran a fraudulent scheme that provided illegal medical interventions to patients suffering from neurological and other terminal diseases. Half a man that he is, even as he publicly spread false witness, shifty tales and cunning lies to hoodwink news media, behind the scenes Stephen Goldfinch was lying, crying, begging and pleading at the prosecutors' feet to save his political career. Dr.Dammai has responded (and will continue to respond) to false witness spread by the disgraced South Carolina politician Stephen Lewis Goldfinch jr. who is endowed with ample immoral values and witless bravado. Dr.Dammai's response is documented in three web pages: case details, public statements and events of the Jan 27th hearing. These links have been published by several prominent newspapers and relevant text from these links have also been reproduced by newspapers in response to Stephen Goldfinch's lies. Although the sordid details of Stephen Goldfinch's crimes still remains buried by DOJ/FBI and FDA, the outstanding investigative work by Will Folks of FITSNEWS reveals the central theme of Goldfinch's con and offers a window into how DOJ/FBI and FDA altered the case facts to protect Stephen Goldfinch and Yair Adereth. Yair Adereth hurriedly left USA to his native country Israel and remains in Tel Aviv.
After FITSNEWS investigation revealed the truth to the public, patients petitioned DOJ to bring SC senator Stephen Lewis Goldfinch jr to justice for his crimes, but government continues to deny patients their due justice. On multiple occasions Cedric LaRue Joubert publicly declared to news reporters that he intends to prosecute Stephen Goldfinch and promised the case was being transferred from Texas to Federal court in South Carolina. However, the dishonest prosecutor never transferred the case and DOJ/FBI and FDA continue to cover up the felony crimes of Stephen Goldfinch and Yair Adereth. Faced with these corrupt officials at DOJ/FBI and FDA, some vigilant citizens tried to press for justice by petitioning via social media and sending emails to then US Attorney Kenneth Magidson. Citizens also collected substantial evidence in the form of authentic email exchanges between Stephen Goldfinch and the quack doctors who purchased stem cells from Goldfinch along with the evidence of payments received by Goldfinch. Images of check payments received by Stephen Goldfinch from Francisco Morales (and other con men) for stem cell purchases were published via social media by citizens. The emails and checks clearly confirmed that Stephen Goldfinch and Yair Adereth actively conspired with medical con men in a multi-state scheme to defraud terminally ill patients. Texas newspapers independently informed public that Stephen Goldfinch and Yair Adereth made 5 Million dollars from fraudulent sale of stem cells across state borders, which are felony violations of interstate commerce at the minimum. FBI, FDA and the Houston DOJ prosecutors, however, thus far have ignored the cries for justice from patients and turned a blind eye to the overwhelming evidence of the "heinous crimes" perpetrated by Stephen Goldfinch and Yair Adereth.
